Legal Question in Insurance Law in California

farmers cancellation

I purchased a liability policy for my business from Farmers Insurance, I give them the first two months in advanced, 45 days later I recieved a notice of cancelation stating that: "Wholesaler of computer is not a class of business written by Farmers Insurance group. Also, no evidence of prior insurance".

I ask the agent to refund my money and until now the only thing that I have recieved is a collection agency stating that I owe Farmers another 104.00 dollars for the last period covered.

I'm very offset with this problem. do you thing this is some thing that will stand out in court in order to get the refund plus any legal fees and compensation.

If they refused to insure your business then you should be entitled to a refund for any coverage after the 45 days. Technically, until they sent you the letter of denial you were covered by the insurance. If a formal letter to the company requesting a refund doesn't work I would recommend hiring an attorney to write a letter and put in a call and that usually resolves the matter.
