Depending on what you complained to HR about, you may have a claim for retaliation. If you went to HR because you believed your boss was discriminating or harassing you on the basis of your gender, race, age, sexual orientation, disability, religion, or other protected category, then any retaliation against you for making that complaint is almost certainly unlawful. However, if your complaint was simply that your boss is mean and treats you horribly for no other reason than he is a jerk or a bad manager, any adverse action against you may not be unlawful. This determination can only be made by an experienced employment lawyer.

If you are retaliated against for making complaints about illegal conduct like discrimination, unpaid wages, etc., then you may have grounds for a 'whistleblower' type lawsuit. However, there are no laws against simple 'unfair treatment' or poor management, abusive treatment, etc. If you believe your complaint makes you into a whistleblower, feel free to contact me to discuss your rights and remedies.
