Legal Question in Employment Law in California

wrongful termination

1 month ago,my company was sold-6 employees were trnsfrrd 2 the new company. 3 employees quit already due 2 commission decrease by $300 a week.Yesterday the 3 remaining employees including me were fired. Weve received different reasons why. Every time it is something different.

1. Business is slow 2. we were unproductive

3. we were too productive 4. The owner made a bad business decision buying company 5. You associate with the workers that quit 6. You stole money. When I asked 4 proof I stole (since theres cameras where the theft supposedly took place)they refused to provide.I can't get a termination letter or copies of anything that I signed. They said the 400 other employees they have fired did not need one. HELP me,I have a family and went from $1000.00 a week to nothing.

Re: wrongful termination

Employers have a legal right to terminate employment at their will. They do not need a reason. From what you describe it does not appear that you have an employment contract that guarantees employment for a specified time nor that you were fired for an unlawful reason. If you believe you did have a contract or were fired for an unlawful reason make an appointment with an employment law attorney near you as soon as possible.

P.S. If you have evidence that this employer is telling people that you were fired for stealing, you may have a case for defamation.

Re: wrongful termination

Thank you for your inquiry.

As Mr. Kirschbaum pointed out, the employee/employer relationship in California is at will, meaning you can be fired for any reason, or for no reason at all. The exceptions are when there is a written contract, or when the firing violates some public policy, such as discrimination based upon race, religion, national origin, or some other protected class.

It doesn't appear here that you would be able to prove or have evidence to prove that the firing was unlawful, and the fact that the company was bought gives them a reason to rely on economics as the reason.

I hope this helps, but if you have further questions, want more information, or feel that you need legal representation, please feel free to email me directly at [email protected]. I am happy to help in any way that I can.
