Legal Question in Medical Malpractice in California

removed wrong tooth...

my 5 yr old daughter was scheduled to have her 2 front teeth removed(baby teeth)...... long story short.... they removed the wrong one to begin with.....and now she has to have the other side tooth removed as well..... so 4 teeth missing instead of 2......can I sue for malpractice??? is there any compensation for any mental/emotional distress in a case like this??? it has caused her (and us) some emotional stress.

Were the two wrongfully removed teeth also baby teeth? If so, it is not likely that an expert will opine that any damage was caused. If the two improperly removed teeth were adult teeth, that could be a different matter. Please feel free to call or consult if you have any questions regarding the foregoing.

Why did the dentist remove the other side tooth? Why did he pull the wrong tooth? How do you know it was the wrong tooth? Did you go to another dentist and confirm whether there was damage done other than being without the teeth? Do you want to send a demand letter?
