Legal Question in Personal Injury in California

my mother was a pedestrian and hit by a car while waiting to cross the street. She was unable to walk and and hospitalized with a fracture that on her leg and had surgury two days ago. She doesnt know how the car hit her. the police report is not ready and we dont know if the car that hit her was insured. she wants for us to file a claim where do i start?

You need to check with her insurance carriers if they provide insurance for UM claims and what they need. They will contact the police department of get a copy of the proof of insurance. Talk to an experieced attorney as is what is likely to happen. So not delay!

I am sorry this happened to your mother. She should not speak to any insurance company or sign anything until she has consulted an attorney. The attorney you retain will not charge a fee until the case is settled (at least I wouldn't) and will handle all of the legwork involved in getting the police report and determining the insurance status and coverage of the driver. The other answers are correct. The 1st thing you should do is have your mother hire an experienced personal injury attorney. This attorney can obtain the police report and determine if the other party is insured. You will also want to find out the amount of coverage available to the other party. If your mother owns a car and has insurance on the car, she may be able to use her uninsured or underinsured motorist coverage. This may also applynif anyone in her household has this type of coverage.
