Legal Question in Wills and Trusts in California

My stepdad just passed in Ca without a will. His wife(my mother) passed away 2 years ago also w/o a will. There are 2 stepchildren, 1 bio son, and 1 bio daughter from a previous marriage. All 4 agree the estate should be split equally. How do we achieve this?

Typically probate is filed to get the ball rolling since that takes a minimum of 7 months no matter what. If the law does not divide the estate how you want then a distribution agreement is commonly done. The probate attorney can usually draft this as part of their service to the administrator of the estate.
