Legal Question in Workers Comp in California

Notice given

I had given notice in early part of November 05, I was asked to reconsider my resignation, I got hurt on the job on November 25, 05, I am still on a off work order and I have not recieved an answer to my case, I have seen a doctor, I called the corporate office today to find out about my case, they said I am terminated, Will i still recieve benefits until I may go bK TO WORK OR SHOULD i CONSULT AN ATTORNEY.

Chances are, they're going to use the post termination defense. However, this can be overcome if your employer had clear notice of your injury prior to your termination.

More than likely the employer will present a post termination defense with respect to your cliam. Without the specifis, it is difficult to say which way the case will go. I recommend that you seek assistance, either from the I&O or an attorney.
