Legal Question in Family Law in Colorado

is it possible to reverse a permanent restraining order?

Hello .. .my husband signed a paper about having a permanent restraining order against him which prevents him from seeing his daughter. He hasn't seen her in over 8 years and wants to know if there is any way that he can reverse the order.

He was misinformed by the lawyer that he used at the time. He was told that if he were to sign the papers that it would prevent him from looking like he was argumentative, or something along those lines. There hasn't been a day that goes by that he doesn't regret signing those papers, but at the time, he thought he was doing what he was supposed to do.

He was NEVER abusive or anything of that nature. During his divorce he was being treated for depression and that was held against him in court.

There isn't a day that goes by that he doesn't think of his daughter and want to see her, be in contact with her, and be a part of her life again.

Do you know if there is anyway that he can try to have this restraining order terminated?

I would appreciate any advice that you may give us.

Thank you.

Stacey

It is not clear what your husband signed, however, if he wants to be a part of his daughter's life he will have to modify the order if he agreed to not pursue visitation and custody. If he has done nothing wrong, then a court should be open to reunification. However, since it has been a very long time since he has seen her, he will most likely need an attorney to represent him, since there are various legal stages he will have to go through to develop a normal relationship with her.
