Legal Question in Legal Ethics in Colorado

Rights of a Limo driver involved in an accident on the job.

I was the driver at fault in an accident in the limousines company car. They want me to be responsible for $1000 deductable which is typically a disclaimer that the driver signs upon hiring but they didn't have me sign that document. Can they sue me if I refuse to pay the $1000? Even if there was less than 8 hours between worked shifts?

Certainly they CAN sue you. Whether they choose to do so, is entirely different. Try to work it out.

You were acting as an agent for the company when the accident occurred, and caused the company harm. They are not required to simply eat that cost, because they did not authorize you (written agreement or not) to damage their property or cause them financial obligations.

Your issue about less than 8 hours between shifts seems to be more a negotiating point, than a valid defense. But, don't be surprised if you get a pink slip, because it sounds more like blackmail.
