Legal Question in Civil Litigation in Connecticut

Hold off forclousure sale

My property is up for forclousure and I have found a buyer and have signed a contract. I am not sure if we will be able to complete the process before the forclousure.

Can I file a motion to postpone the forclosure date?

Yes, you can file a Motion to open and reset the date. Is it a strict forclosure or a sale? How far off is the sale date? A lot depends on these questions as to whether or not the Court will grant your motion or if you would have to file banruptcy to stop the process.

Good luck.

Re: Hold off forclousure sale

Even if you can't postpone the foreclosure, assuming it is a foreclosure by sale, the foreclosure isn't final until the sale is approved by the court. If you come up with the money to pay off the mortgage (through the sale) before the sale is approved, you can redeem by paying off the mortgage. If it is strict foreclosure, this does not apply.
