Hi, my mother passed away in September of 2007 suddenly and unexpectedly. I am very interested in getting her medical records. My mother was married to a man that is not my father and he initially agreed and signed a release form in order for me to get the medical records. The hospital where she died will not release them unless we show probate paperwork. He has no intention of filing probate paperwork and I am left not being able to get her records. Is there anything I can do?

You would have to open a probate estate for her. You could do this as her son.
