Legal Question in Credit and Debt Law in Florida

Judgements

Can a judgement on a charged-off credit card bill be made without my knowledge? I've recently been getting numerous collection agency calls about a credit card bill that was charged off in 1995 (I could not pay any longer due to an illness that began in 1993), however, I was never served a complaint by the bank that maintained the credit card account.

Re: Judgements

If you never were served with a complaint and summons, the answer is no. Many times collection companies will state there is a judgement when in fact there is not. Such statements are a violation of law.

You should check the clerk of court to see if a judgement has been entered against you.
