Legal Question in Credit and Debt Law in Florida

If I turn in a auto of my own free will and the lender sell it at auction for less then pay off, can they make me pay the difference and can they put a lein on my home?

They might be able to get a judgment against you if they choose to sue you for the difference between the value of the car and what you sold it for, but probably can not lien or sell your house if is your homestead. Feel free to call or e-mail me with any further questions.

It is very important that you keep all the records re the acution of your car. The laws regarding this are very exact and if they fail to do it right, you will have a claim against them. Have someone look at the notices who does consumer law.
