Legal Question in Criminal Law in Florida

Grand Theft 3rd Degree

What is Grand Theft? When I unknowingly attempted to cash a check I was arrested. How is attempting to cash a check theft if no money exchanged hands? Where can I find the Florida law about Grand Theft?

You should not rely on or take action based on this communication without first presenting ALL relevant details to a competent attorney in your jurisdiction and then receiving the attorney's individualized advice for you. If you do not agree, then stop right here, and do not read any further.

The elements of grand theft are

(1) knowingly (2) obtaining or using, or endeavoring to obtain or use, property of another (3) with intent to deprive the person of a right to the property or a benefit therefrom, or to appropriate the property to one’s own use or to the use of any person not entitled thereto.

(summarizing section 812.014, Florida Statutes). You can find a copy of the Statutes online by searching Google or you can go to most public libraries and find copies of the Florida Statutes in a book. Of course, all lawyers usually have the statutes in their offices too.
