Legal Question in Criminal Law in Florida

Pretrial Intervention Revoked

My 18 yr old son was accepted into a pre-trial intervention program for a marijuana possession, under 20 grams. 3 months into the program, he was arrested for ''Underage Possession of Alcohol.'' He was on the beach with a group of friends that had a cooler of beer. The cooler was not his. Everyone took off when the cops came leaving my son with the cooler. One of the cops was joking around with him saying ''don't you guys know you're suppose to leave the beer in the car and use cups?'' My son was not drinking, did not have an open container, but took the blame and was taken to jail. PTI has now been revoked and court set in two weeks for the marijuana possession. Can't afford an atty (was quoted $5K), may get Public Defender. Any idea of what type of punishment he's facing?

Re: Pretrial Intervention Revoked

Your son is most likely looking at a probation sentence, probably 12 months. In some circumstances the sentence includes a drivers license suspension but that can be avoided. I would be happy to discuss this situation with you further and answer any other questions you may have. You will have to view my profile for my contact information.

Thanks,

I would suggest you retain an attorney for your son.By failing the pre-trial program the state attorneys office will be harder on your son.If you want to e-mail Me phone number I would talk to you about the case.
