Legal Question in Criminal Law in Florida

statuatory rape

If I .. a 42 y/o man with my profile on an ADULT dating site.. gets propositioned by a 20 y/o on line.. have sex at her apt in the middle of the night, only to find she is a 13 y/o and is pregnant by me... will i be prosecuted for statuatory rape and labeled a sex offender... I may be being scammed but I just received a voice mail from a woman stating to be the mother of a girl I slept with in this situation. What can I do, what should I do... is my life over for being fooled by a girl (if its true) who is still on the site , and the site makes you mark off that you are over 18??

Re: statuatory rape

You need an attorney IMMEDIATELY. You should speak to no one without speaking to an attorney-not the "mother", not the girl, and especially not the police. Your computer may be seized so keep that in mind. But above all, you need to immediately retain a competent lawyer that specializes in criminal defense this morning!

Re: statuatory rape

Yes, you can be prosecuted for lews and lascivious battery (statutory rape). Importantly, ignorance of the victim's age is no defense.

I would suggest hiring an attorney and ceasing all communications with her.
