If I divorce my illegal husband, can I put my child up for adoption?

I have been married for 6 months, my husband is an illegal immigrant. (he has a deportation order from 2001) After marrying my husband I became pregnant. He became abusive, and was arrested for beating me. I want to put the baby up for adoption. He wants custody of the baby. If I divorce him before the baby is born, and the baby doesn't have his name, and he is not on the birth certificate, will he have any legal rights? Or can he stop me from puting the bay up for adoption?

As the father you will need his consent. I suggest you seek family counseling. good luck.
