Taking child out of town

My husband has temporary custody of his child and we want to take him out of town for the weekend to the beach three hours away. He sent an email to his ex three weeks ago letting her know this and she has not responded. He has emailed her four times since and still no response. Do we need her permisson to go on vacation? Does she legally have to respond?

Absent a court order to the contrary, no Florida law prohibits taking the child outside the state on a temporary, short-term basis.

Provided the custody agreement and/or divorce decree doesn't prohibit it, then there should be no problem with it. I would suggest that if your husband is concerned about it he should contact the attorney who represented him in the divorce and ask him/her for some guidance in this matter.
