Legal Question in Civil Litigation in Florida

How to drop a counter suit

Because of extensive damages as a result of an interstate household goods move, I stopped payment on my payment check. Subsequently the mover brought suit against me in Florida small claims court for the amount due for services. I instituted a counter suit for damages.

I would now like to drop the counter suit to make this situation less complicated.

Is there a certain procedure or format for doing this?

Re: How to drop a counter suit

If you are absolutely sure you want to drop the suit then file a "Notice of Voluntary Dismissal Without Prejudice" and below this write, Notice is hereby given that counter-Plaintiff hereby files this voluntary dismissal without prejudice. Sign it, mail a copy to the opposing party and to the court. Good luck,

Randall Gilbert
