Legal Question in Civil Litigation in Florida

Is it ilegal to be videotape without consent or permission.

I had some bounty hunters looking for information about my daughters ex-boyfriend. I let them in and cooperated to catch the guy. They never told me they were videotaping or recording our conversation. They also said that no one was to know that me and my daughter helped. My daughter is 17 years old. Now, the bounty hunters have a t.v show and in one of the episode I come out. I had no idea and me and my daughter were mentioned throughout the show. My daughter is being affected because other student at school make her feel uncomfortable with negative comments and remarks. Can I file a lawsuit for being taped without my consent? I also have the show in tape, I recorded it.

Yes, it is absolutely illegal to record any conversation without authorization from the other party. Videotaping would be included. The unauthorized recording is a criminal violation. I have not researched the topic, but it will probably include civil penalties as well or have a civil law that would coincide with the criminal law.

At the least, you can obtain an order prohibiting them from using your likeness on the show. I presume you are referring to the Bounty Hunters Miami show which is broadcast on The Court TV. It was a joint venture between the bonding agency and the network so you may have some deep pockets if damages are awarded in court. At this point, you need to retain an attorney to discuss your options and to take action to stop further broadcasts of the show.
