Legal Question in Landlord & Tenant Law in Florida

I am married and purchasing home in Florida. My named spouse is not financing the property with me and we do not want him added to the deed or have to sign at closing. Can he waive his rights to Homestead so he does not have to sign the deed or should we have finalized our divorce prior to home purchase?
