Diamondbrite pool defect

I had a company resurface my pool over a year ago and about 8 months ago I noticed cracking in the surface they assured me that they would repair it. Well 7 months passed before I could get them to start work and now that they have it has not been completed . My pool has been empty for the last 6 weeks. Repeated calls have been made and bad weather has been the excuse. But believe me It has not rained every day since they have started.Would it help to have an atty. draft a letter and how much would that cost me?
