Our Home owners association board have allowed residents to be in arrears with teir maintanence dues, can i sue the directors for Breach of fiduciary duties, and would the board then have to pay the past dues themselves ?

No but you certainly can find out why they are permitting this & whether it is detrimental to the HOA.
