Is it against the law for a married man to by real estate stating he is single? If so what couse of action can the wife take

Depending on the facts of the situation the other spouse may have a claim to the property. If you are concerned you should consult with an attorney.

If he is using joint funds, then you can get a court to add your name to the title. You should probably consult with an attorney anyway if your spouse is doing something like this.
