Legal Question in Consumer Law in Georgia

Summary Judgement

Can I get a summary judgement reversed in the state of Judgement? I have heard about a petition to reopen but don't know what form to fill out. We did not answer the Motion for Summary Judgement because after the plaintiff filed the motion, the judged ordered mediation. And in his mediation letter, it states that if no agreement is reached ''the case will go to trial.'' Thus, we thought after mediation we could go to trial and oppose the summary judgement motion and file a motion to dismiss because they did not prove the case. We also found evidence that they used a false affidavit to support the summary judgement.

Re: Summary Judgement

If you had a judgment entered against you for failure to understand the procedural rules and time limits, and perhaps have failed to take the proper action to ask for reconsideration during the time allowed, it would be even more negligent to continue without a lawyer. The time to contest their affidavit and evidence would have been during the appropriate response time.
