What is the punishment for the first DUI in GEorgia within 5 years?

When you go to court you can anticipate a fine of between $300.00 and $1,000.00, and twelve (12) months probation as part of your sentence. You will also be required to complete a DUI risk reduction course and perform a minimum of 40 hours of community service as part of your sentence. You may be required to take a drug and alcohol evaluation depending on the court.

There is also the possibility that you might have to spend some time in jail or perform trustee work in lieu of jail time. If it's a first dui in five years you should be able to get a first offender affidavit which can be used to obtain a limited driving permit for the minimum 120 day suspension period. Your regular license will be suspended when you go to court, but you should be able to obtain a temporary license. After 120 days you may apply for a reinstatement of your regular license.
