Grandma have Guardinship

I hve guarnshp of my grandson becse the dad wnt to jail for 5 yrs & wl be getn out this yr-whn he wnt to jail - the mom started hangn out & ptyn & didn't hve time for the 6 yr old - he ws failing in kindergarten, he ws raggedly & she ws leavn him wth anyone -- she ws a good mom b4 the dad wnt to jail & I believe she wl be a good mom whn he gets out this yr - whn we signed the guardnshp papers I did write tat I was wilin to help the mom out till she got herself together as far as a job and a plc to stay --she do hve both now - & I believe she wl stop runn the strs whn the dad gets out of jail - however - she still wnts to be wit the father whn he gets out, but he do not wnt to be wit her because of her sleepn with underage boys whn getting drunk at her 15 yr old daughters' b'day pty - it ws all ovr the sch - the daughter dropped out of sch because the boys & girls in the sch knw wht had happened at the pty & she also slept with a few of the dad's friends in their hme, car etc. I don't mine her gettn my grandson bck but once she see the dad don't wnt her - she may start ptyn again..my ? is -can a grandparent hve guarnshp in one state & the mom in anthr state in case I need to get my grandson bck with no hassel. I live in ga- she ny

If you are a guardian, then you are under an obligation to assure the well-being of the child entrusted to your care. You need to honestly evaluate whether a a court, or the average citizen would conclude that you acted reasonably by allowing a mother who you apparently know has slept with underaged youths, and allowed her teenage daughter to sleep with friends of her incarcerated father, is a good candidate to be a custodial parent. If you have any doubt about how this question would be answered, then you should consult your county department of family and childrens services or the court that entrusted the child to your care.
