Defamation or Malicious Prosecution

Two years ago I was sued in civil court by my former employer for Theft of Trade Secrets and I counter-sued for FLSA infractions. My employer dropped the suit against me and settled for the back wages that were owed to me. My attorney drew up the settlement agreement in which all parties signed. Last week I was pulled over for a traffic violation and arrested for an outstanding warrant for theft of trade secrets sworn out by my previous employer. Can I sue him for defamation or malicious prosecution.

I think the timing of the taking out the warrant is going to be the key. If the warrant was taken after the settlement, I think you definitely have a case. If it was taken out before and just forgotten about, maybe not. Consult with a local attorney.
