should i get a lawyer

i was given the wrong prescrition at a pharmacy. i questioned it at the window and they assured me it was correct. theygave me 40mg paxil instead of prozac. it was there mistake. the dr. prescribed prozac.

You failed to mention how you were damaged? Did you take the pills? Did you have a physical reaction? Did you call your doctor? What did the doctor say when you called him/her to discuss the issue? If there was an error, it should be addressed by the doctor or other appropriate party, but you don't state sufficient facts to go beyond that.

It sounds like you were careful, and that you caught the pharmacy error before your health was significantly harmed. If you were not significantly harmed, than there is no reason for you to pursue a claim.

No amount of money can really compensate a person for a significant and life changing injury. In cases where folks are injured due to the errors of others, we are limited to using money as a vehicle to compensate the injured and sometimes to punish the bad actor� but money is a poor substitute for the actual loss.

In your case, it seems reasonable to request a refund, however, this is more of a customer service rather than a legal dispute.
