Legal Question in Personal Injury in Hawaii

Who is at fault? A person parks on the side of the road, opens the car door to exit the car and a bicyclist runs into the door and is injured. Scene: beach; many cars parked on side of rode. Injuries: possible fractured hip.

Each case is different depending on all the facts taht are presented.

However, Section 291C-125 of the Hawaii Revised Statutes entitled �Opening and closing vehicle doors� provides:

No person shall open the door of a motor vehicle on the side available to moving traffic unless and until it is reasonably safe to do so, and can be done without interfering with, or causing immediate hazard to the movement of other traffic....�

Liability will likely depend on how much time the bicyclist had to avoid hitting the door. Were you the bicyclist or car driver?
