There is no such thing as "tort of appearance", and the other phrase is defined in a French English Dictionery as random or crosswise. I have been a personal injury / negligence attorney for longer than I want to admit and one of my law school professors did in fact help write the book on negligence law. If anyone is telling you that either of these phrases has any relevance to the actual law, they are playing games.
