Legal Question in Family Law in Illinois

adoption

What would I need to do if a friend cannot take care of his daughter and s willing to give her to me to raise? He does not want to go thru to much paper work or thru the courts? Please help? I really want this child. The birth mother has past away, so he would be the only parent.

Re: adoption

Hello and Happy Holidays. In my

opinion, the best option would be for

you to adopt your friend's daughter.

This would insure that you would have

legal rights to the child and she would be entitled to any and all of your benefits through the adoption. I

will be happy to discuss this with you further and in more detail.

Re: adoption

Unfortunately, you do have to go through the courts. Whether it be adoption or a guardianship, you have to go to court. YOU can't enroll her in school, or get her health care unless you're the LEGAL guardian. Just signing a piece of paper saying so doesn't work. You won't have any legal authority otherwise. The two of you are dealing with a child, not property.
