Legal Question in Personal Injury in Illinois

I have a very large dog. I live in the country so she is free to roam our property. I will tie her up if I know that someone is coming over. Not that I'm afraid she'll bite but because some people are intimidated by her size. However, there have been many strangers that have stopped for directions. I have signs that warn beware of dog that cannot be missed. Many times people get out of their vehicle and then ask if the dog will bite. I would like to know if the unthinkable occurs, am I protected by having a dog warning sign if these people are actually dumb enough to get out of their vehicle? She has never shown any indication of biting.

Maybe not. Under Illinois law, the only defense by an owner to a dog bite claim is that the claimant provoked the dog. The best protection is to have liability insurance that covers you for this. Such liability coverage is typically provided with your homeowners or renters policy, but you should read any such policy or check with the agent who sold it to you. If you don't have such coverage, you should get it.
