Legal Question in Personal Injury in Illinois

mediation and arbitrations

I am in the process of a lawsuit against a nursing home that caused gross personal injury and the death of my mother. It has been over two years and we were suppose to meet with a mediator the 5th of May. The defendents have made my life a living hell and I've been through mental and physical stress (heart attack) over all of this. Now they have moved the mediation date up to June 2nd. I don't feel that my attorney is standing up for me. The defendents seem to do anything they want and I have no rights at all.

Can I tell them to forget the mediation and that I want a trial or is that their decision also?

Hello -

I understand your frustration, but

it is important that you attend the

mediation/arbitration. If you fail

to attend, you may forfeit or waive

your right to reject the decision of

the arbitrator, and then you would

not be granted a trial in the matter.

Write your lawyer a letter and tell

him what you want. Verbal commands

sometimes are lost in all the other

cases that an attorney may have to

deal with. Lawyers are only human ...

but a letter gets the point across in

most instances. I hope this helps you.
