Employee Vs Employer

We are employee of govt sector /PSU . We are selected as semiskilled artisian with ITI qualification through employment exchange. Also the PSU is recruiting the skilled artisian with same qualification through open market. However the job working nature is same for both category.

After or before our recruitment No semiskilled is recruited.

iIs the matter justified?

Can a ITI with specific trade can be treated as semiskilled?

Can we move for justice in court? Is there is a policy of recruitment through employment excahnge with a level down recruitment post?

If in a PSU person with particular qualification are placed under one cader then in the same psu person with same qualification cannot be placed in lower cader, merely because of its source. It is principle of service jurisprudence that "equal pay for equal work".

SO in that case you can certainly move to court of law for equality
