I had entered into a construction contract with a local builder to bring up a cottage at Kodaikanal Tamilnadu and had authorized him to deal with local pachayt officials on all matters connected with the construction as I was working in Gulf at that time. The builder escalated the cost of construction and delayed the handing over which was turned down by a Consumer forum and handing over of the possession was ordered. While the builder obeyed I was shocked to know the local panchayat had not approved layout/building plans on reasons of some disputes on the land on which the construction was done. However the panchayat on my petition along with layout/building plan made by me issued local order to give covering sanction based on the Consumer Court order. I had spent quiote some money to procure the sanction. The Consumer forum refused to compensate the expenses as the issue was not raised in original petition. I understand from a book on Devolution of Powers �Courts, Panchayaths and Nagarpaliks� by Sri C.Sivaramakrishnan that in the passage of time since the formation of Pachayat Raj they have become a local judiciary authority. Exercising the powers conferred on it can the Pachayat order the builder to compensate me the expenses?

You may need to consult a local lawyer dealing with the subject - local laws concerning Panchayats.

You may also consider filing a fresh complaint before the Consumer Forum claiming damages from the builder.
