Legal Question in Family Law in Indiana

Power of Attorney

My husband and I need to deal with medical bills for his mother, who has been in the hospital for 3 months, and father. We are taking care of all medical bills as well as other bills, etc. I cannot get info regarding the med. bills since I'm not one of them and don't have power of attorney. What do you think I need in order to handle their financial and medical affairs, including with med. insurance and medicare?

Re: Power of Attorney

You either need a Power of Attorney or to file for guardianship.

Re: Power of Attorney

If they are mentally/physically competent, that is, they can understand and appreciate the giving of appointing you as their attorney-in-fact under a Durable Power of Attorney, then that is the way to go. You will need an attorney who is willing to go with you to the hospital, or home, in order to explain it to them and have them execute the document(s).

If they are not competent, then the only way to do what you want done is to do a Guardianship for each of them.
