Legal Question in Wills and Trusts in Indiana

Successor trustees

The trustee of my mother's trust passed away and no other trustee declared. Asone of 2 surviving sons, what can we do to appoint me and my wife as successors.? My other brother is mentallychallenged and I have been appointed as his guardian. The trust set up funds for his benefit to be controlled by the trustee. I was told that probate court is not required to achieve this. --name removed--Devaris

You should contact an attorney to assist. The trust itself will need to be reviewed and if your Mother has passed there may have to be court intervention. You did not leave enough facts.
