Legal Question in Family Law in Kentucky

ownership after divorce

I divorced in 1999 in bell co. ky.,and signed away all marital rights to the home we owned together, and then continued to live in the same home together for another eight years. The judge put a clause in the final divorce saying if ex husband missed a payment that I could force the sale of the home, which has not happened. I want to if he sales the house or if he dies before me do I have any legal rights to the home?

Re: ownership after divorce

Because you are not married, then you do not have any clear legal rights to the home. There is a very weak argument that could be made based on a legal doctrine called quantum meruit and one on promissory estoppel that might give you some compensation IF you can prove you paid on the house post divorce and if there was a promise that you would get a share of the proceeds or something similar. It would be worth consulting with a lawyer over the exact details of the situation, but I would not get optimistic about it.
