i need to get out

i want to return to NY with my son,Do to mental abuse and fighting in my marriage. These fights are getting to the point where there going to be physcial.Can i take my son with me.

The most legal thing to do would be to file for an Emergency Protective Order for yourself and your son. Violence includes the threat of violence. If found to be true by the Judge, you would then have a Domestic Violence Order and you would most likely have temporary custody of your son.

There is no law, unless a court order has already been issued on the matter of leaving the state or custody, that would prevent you from going to New York with your son. I cannot speak for New York law, but if you do go there, you can look into whether you can file for a protective ordere there.
