Legal Question in Workers Comp in Louisiana

Suing general contractor

Can an employee of a sub-contractor sue the general contractor or the landowner for an unsafe work environment? Is workmen's comp the only remedy? Is it a remedy at all/

Re: Suing general contractor

There are certain instances in which a general contractor can be sued under a "statutory employer" theory. Whether you can do that depends on the facts of the case and is impossible to determine without a detailed and through consultation with an qualified attorney.

You should seek the advice of an attorney to determine your rights and rememdies as soon as possible.
