Ok, i am in the usa on a visa wavier, i have a girlfrend here and want to marry her without going home first as it is to expensive what will happen first if i try to leave adfter the date , will i get detained or will they let me go home with a ban.

secondly if i stay and marry her is there any law that will protect me

If you depart the USA after expiation of the period of 3 months (allowed for a visa waiver visitor), you will no longer be able to travel to USA on a visa waiver and can be denied admission to the USA when you try to enter the United States in the future.
