Legal Question in Real Estate Law in Maryland

I have a shed that was built on my property about 21 years ago that is on property owned by the HOA but no one has ever said anything and it has been there for ever. I am selling my property and do not want this to be a sticking point. Do I now own this property and the shed or do I have to move it. Thanks

Your question is a bit confusing. You state that the shed was built on "my property about 21 years ago that is on property owned by the HOA." It can't be both. Regardless, it sounds like you want to know whether you can claim the shed and the property that it sits on through "adverse possession." The answer is "it depends." I strongly recommend that you consult a Maryland real estate attorney, who can listen to the specifics of your situation and advise you on your options concerning the shed and how it may (or may not) affect your ability to sell your property.
