Legal Question in Technology Law in Massachusetts

Stolen Website by Employee at LLC

My company (LLC registered in Delaware) hired a programmer to improve upon a website that had already been professionally built. He did sign a contract that stipulated he was an independent contractor and it laid out what he would be paid and what improvements he would be making to our site. We transferred our site and database to a server under his control so that he could work on it. For the past year he has been difficult to contact and I have not heard from him for several weeks now. He has worked from home since we first hired him, first from New Hampshire, then Prague, then back to the US in Florida and now he told me he has moved to Indonesia. At this point I just want my website and database returned to me. What are my legal options? Any help would be much appreciated.

Re: Stolen Website by Employee at LLC

Your problem is that he is in Indonesia. You can demand he return it and file suit here under the breach of contract. However, getting the website back will be difficult and expensive. If it is a legitamate ISP provider you can name them as a party and have them ordered to transfer control to you.
