Legal Question in Consumer Law in Massachusetts

There was some kind of credit deluxe program added to my husbands credit card bill for the past year and we didn't realize it till last month on the statement. I called to see what it was from and the company it was from said they would and investigation and send me a letter. I received the letter saying this program was added over the phone, so I then called them back and said I would like proof of this because he did not request this service at all. They said to me that all they can do is send a letter on how this service was activated and they will not due any further investigation. Is it legal for them to do this? Do they have to provide me with the proof of this phone call they are talking about?

This company probably has a greater obligation to you then they care to acknowledge. They not only should comply with your request for adequate proof of your authorization, but should probably return all of the fees which they received upon your written demand.

Please feel free to contact this office if we can assist you further in this matter.

P.S. Be sure to send all correspondence by mail (w/ proof of receipt), and to log all phone conversations.

There has to be some evidence of authorization for this service. If you create a stink, they may rebate the amount taken.
