Legal Question in Family Law in Massachusetts

My husband of 20 years wants a divorce. We have 3 kids w/only 1 minor which will be doing joint custody. We own our home, we have a 2006 Yukon, a 1997 Ford F250, a raceatv worth $6000 and an 18' trailer worth $6000. He makes a minimum of $8000 a month. What am I entitled to?

It is really impossible to speak to your specific situation without reviewing financial statements, the parties' work history and education, the emancipation status of your children, etc.

Based on only the information above, you may certainly request alimony. Depending upon the emancipation status and living arrangements with your children, there may be an award of child support. Visitation, college, and other considerations should be discussed. You mention that you own your own home, but you will need to decide how the home is going to be dealt with. You will need to discuss health insurance, taxes, the nature of your husband's employment, your current income and earning potential, etc.

All that can be said is that you are entitled to a fair division of the marital estate in light of a number of factors. You have the option of either trying to work out a divorce plan together with your husband, or suing him for divorce and asking for a judge to work out a divorce plan for you.
