It is illegal for an employer to withhold wages from an employee. You should speak with an attorney as soon as possible.

Re: delay of payment

Under state law, the non-payment of wages can result in the award of treble damages plus a reasonable attorney's fee and interest. Federal law provides for double damages in some instances. I would need to find out the specific circumstances of your case to know if you have a solid case and to ascertain the what violations of law have occurred. Because state law is generally most favorable to employees, most cases are initiated by filing a complaint with the Wage and Hour Division of the Attorney General's Office. You can do that on your own, or, you can seek the assistance of an attorney. In many cases such as yours, attornies are able to undertake the cases on a contingency fee basis, where the client pays the attorney a percentage of the recovery and the client doesn't owe the attorney his or her fee unless money is recovered.
