Legal Question in Employment Law in Massachusetts

my job owes me money :(

Hi, I just graduated from college and got a job at a Design Firm doing floor plans. I've been at this Firm for over 4 months and still haven't gotten paid. The job is by comission, but they said it would only take about 2 months to get paid. They also promised me that they would reinburst me my expenses, but they haven't! What can I do :(

Commissions are considered "wages" under the Massachusetts Wage Law. An employer's failure to pay wages to an employee when due will subject the employer to liability, including mandatory triple damages and attorney fees.

It is a little unclear from your post whether the employer has refused to pay commissions owed to you, or whether you have been unable to earn any commissions in your first four months.

If you have an employment contract with your employer, you will want to review it carefully to see when and how wages/commissions/expenses are due. You might want to start with a simple demand for payment of wages in writing to your employer. If you don't get a response, you will want to file a complaint with the Attorney General's Office, Fair Labor Division.

I am going to be relocating my practice into your neighborhood on December 1. In the meantime, please feel free to contact me should you have any further questions.
