Re: someone working on a home with no insurance

Liable for what? Are we talking negligence, arson, worker's comp.? What?

Generally, Homeowners who hire an uninsured contractor are setting themselves up for failure and a lawsuit. Whatever the contract is between the homeowner and contractor, that does not affect the rights of third parties (such as employees or anyone else). Insurance is cheap and if the contractor is uninsured, you can bet your bottom dollar that there is a reason why no one will insure him and his employees... they are dangerous. Plus, if he cannot afford insurance, what are the odds he will have the money to pay for either a building defect or a personal injury?

RUN AWAY! Do not walk. Find a good contractor who has a good business reputation and who has a current insurance policy. Otherwise, you will be on this website in a few onths complaining that either a) something was not built to code and the Town has ordered it torn down (at your expense) or b) someone got injured and now there is a lien against your home and a large lawsuit pending. Not having worker's comp. insurance is a crime in Massachusetts. Do you really want to place your trust in a CRIMINAL?
