Legal Question in Wills and Trusts in Massachusetts

Dad recently deceased. Mom is asking me to sign Allowance of will without testimony, probate of will without sureties and assent to appoint her temporary executrix. Does this mean I am part of my dad's will and she is trying to hide this from me? Can I see the will?

I'm sorry to hear about your loss. Based on your post, your mother's actions appear to be completely normal. The will is going to have to be probated as part of your mother's request to be appointed executrix - you can either request a copy from your mother (or her attorney) or go to the court and view the will yourself. If you would like some assistance in this matter, please feel free to contact my office. 617-357-4898.

Please accept my condolences. This is normal requests to avoid a hearing on the Will and appointment of the Executrix. The Will will be filed with the Probate Court so you can get a copy if you are not otherwise provided a copy. You are being aske to sign regardless of whether you are a beneficiary under the Will as you are an heir by statute. Your father however can leave his estate to anyone he pleases and does not have to leave anything to his children.

If you need assistance please feel free to contact me.

You have a perfect right to request information from her, and have that information reviewed by an attorney.
